Refund Policy

1. Overview

This Refund Policy explains the circumstances under which refunds are available for digital music products purchased from MoreTekk. This policy complies with Spanish and EU consumer protection law.

Important: Digital content that has been downloaded is generally non-refundable under Spanish and EU law, except in specific circumstances outlined below.

2. Right of Withdrawal for Digital Content

2.1 Legal Exception for Digital Content

Under Spanish and EU consumer law, the standard 14-day withdrawal right does not apply to digital content that:

  • Is not supplied on a physical/tangible medium
  • Has begun to be performed/delivered
  • Was delivered with the consumer's prior express consent to immediate delivery
  • The consumer acknowledged losing the right of withdrawal upon download

2.2 Express Consent Requirement

Before completing your purchase, you must provide express consent that:

  • You agree to immediate delivery of the digital content upon payment
  • You acknowledge that you will lose your right of withdrawal once the download begins

This consent is recorded at checkout and is required by Spanish and EU law.

2.3 Before Download Begins

If you have NOT yet downloaded the digital content, you may request a full refund within 14 days of purchase by contacting support@moretekk.com. Once the download begins, the right of withdrawal is lost.

Note: This withdrawal right does NOT apply once you have downloaded the digital content, as you provided express consent to immediate delivery and acknowledged the loss of your withdrawal right at checkout.

3. When Refunds Are Available

Despite the withdrawal exception, you may be eligible for a refund in the following circumstances:

3.1 Defective or Corrupted Files

If the digital content you purchased is defective, corrupted, or cannot be downloaded/played properly, you are entitled to:

  • A replacement copy at no additional cost (preferred remedy)
  • A full refund if replacement is not possible or unsuccessful

Time Limit: Claims must be made within 30 days of purchase.

3.2 Content Does Not Match Description

If the digital content does not conform to the description provided on the product page (wrong tracks, different quality than stated, etc.), you are entitled to a full refund.

3.3 Duplicate Purchase

If you accidentally purchased the same product twice, you may request a refund for the duplicate purchase within 7 days.

3.4 Unauthorized or Fraudulent Transaction

If your payment method was used without your authorization, please contact us immediately at support@moretekk.com. We will investigate and issue a full refund if fraud is confirmed.

3.5 Technical Issues Preventing Download

If technical issues on our end prevent you from downloading your purchased content within the 30-day download period, and we are unable to resolve the issue, you are entitled to a full refund.

4. Non-Refundable Circumstances

Refunds will NOT be provided in the following cases:

  • You changed your mind after downloading the digital content
  • You no longer want the content for personal reasons (not interested, don't like it, etc.)
  • You made a purchasing decision based on your own mistake (e.g., purchased the wrong item after reading the description)
  • You lost access to your download link after the 30-day download period expired
  • Technical issues on your end (incompatible device, insufficient storage, internet connection problems)
  • You violated the Terms of Service or license agreement

5. How to Request a Refund

5.2 Information Required

Please include in your request:

  • Your order number (found in your confirmation email)
  • Email address used for purchase
  • Detailed reason for the refund request
  • For technical issues: description of the problem and any error messages

5.3 Response Time

We will respond to your refund request within 7 business days. If approved, refunds will be processed within 14 days of approval.

5.4 Refund Method

Approved refunds will be returned to the original payment method used for the purchase. Please allow 5-10 business days for the refund to appear in your account, depending on your payment provider.

6. Legal Guarantee

6.1 Guarantee for Digital Content (Single Supply)

As a consumer in the EU purchasing single-supply digital content (one-time download), you are protected by legal guarantees. Digital content must:

  • Conform to the description provided
  • Be fit for the purposes for which such content is normally used
  • Possess the quality and performance described

Guarantee Period: For single-supply digital content like music downloads, you may claim remedies if defects existed at the time of supply or manifest within a reasonable period after supply. We accept claims within 30 days of purchase for download and playback issues.

Note: This differs from the 2-year guarantee for physical goods. Single-supply digital content has a guarantee covering defects present at delivery or manifesting shortly thereafter.

6.2 Burden of Proof

If defects appear within the first 12 months from delivery, it is presumed that the defect existed at the time of delivery, and we must prove otherwise. After 12 months, you must prove the defect existed at delivery.

6.3 Remedies

For defective digital content, you may claim:

  • Repair/Replacement: Free replacement of defective files (primary remedy)
  • Price Reduction: Proportional reduction if repair is impossible
  • Refund: Full refund if repair/replacement fails or is disproportionate

7. Chargebacks and Disputes

Please contact us first: Before initiating a chargeback with your bank or payment provider, please contact support@moretekk.com to resolve the issue. We are committed to fair and prompt resolution of all disputes.

Initiating a chargeback without first attempting to resolve the issue with us may result in:

  • Suspension or termination of your account
  • Denial of future purchases
  • Legal action to recover costs (in cases of fraud)

Legitimate chargebacks (unauthorized transactions, non-delivery) are always honored.

8. Online Dispute Resolution

If you are a consumer in the EU and are not satisfied with our response to your complaint, you may use the European Commission's Online Dispute Resolution platform:

9. Changes to This Policy

We may update this Refund Policy from time to time. Material changes will be communicated via email or a notice on our website. The updated policy will not affect refund requests already in progress.
