MoreTekk provides the following services:
- Sale of digital music products (audio files, albums, EPs, singles)
- Streaming and preview of music content
- User account management and authentication
- Download delivery of purchased digital content
All digital products are delivered electronically in high-quality audio formats (FLAC, MP3, or other specified formats).
4. User Accounts
4.1 Account Creation (Optional)
Creating an account is optional but recommended if you wish to keep a record of your purchases and access your purchase history. You may make purchases as a guest using only your email address.
If you choose to create an account, you may register using:
- Email and password
- Third-party authentication (Discord, Google, Spotify)
4.2 Account Responsibilities
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4.3 Age Requirement
You must be at least 16 years old to use our services. If you are between 16 and 18, you must have parental consent to make purchases.
5. Purchases and Payment
5.1 Pricing
All prices are displayed in Euros (€) and include applicable VAT (IVA). Prices are clearly shown before purchase and may change without prior notice, but changes will not affect orders already placed.
5.2 Payment Methods
We accept payments through Stripe, which supports credit cards, debit cards, and other payment methods. Payment processing is secure and encrypted.
5.3 Order Confirmation
Upon completing a purchase, you will receive an email confirmation with:
- Order details and product description
- Total price including VAT
- Download links for your digital products
- Receipt for your records
5.4 Contract Formation
The purchase contract is formed when you receive the order confirmation email. This email constitutes acceptance of your offer to purchase.
6. Digital Content Delivery
6.1 Delivery Method
Digital products are delivered immediately upon successful payment via download links provided in your account and confirmation email. Downloads are available for 30 days from the purchase date, but you may download them multiple times within this period.
6.2 Technical Requirements
You are responsible for ensuring you have compatible software and sufficient storage to download and use the digital products. Supported formats are listed on each product page.
6.3 Access Issues
If you experience technical difficulties downloading your purchased content, contact support@moretekk.com within 30 days of purchase for assistance.
7. License and Usage Rights
7.1 License Grant
Upon purchase, you receive a non-exclusive, non-transferable, perpetual license to use the digital content for personal, non-commercial purposes.
7.2 Permitted Uses
- Personal listening and enjoyment
- Transfer to personal devices (phones, tablets, computers, etc.)
- Backup copies for personal use
7.3 Prohibited Uses
You may not:
- Distribute, share, or make available the content to third parties
- Use the content for commercial purposes without written permission
- Remove or modify any copyright notices or metadata embedded in the files
- Resell, rent, or lease the digital products
- Use the content in public performances without proper licensing
8. Right of Withdrawal
8.1 Digital Content Exception
Important: Under Spanish and EU consumer law, the right of withdrawal does not apply to digital content that has been delivered if:
- The content is not supplied on a tangible medium
- Performance has begun with your prior express consent (clicking "Purchase" or "Download")
- You acknowledge that you will lose your right of withdrawal once the download begins
8.2 Express Consent
By completing your purchase and downloading the digital content, you expressly agree that:
- The digital content will be delivered immediately
- You waive your right of withdrawal as provided by Spanish and EU law
This consent is required by law and is presented clearly during the checkout process.
8.3 Before Download
If you have NOT yet downloaded the digital content, you may withdraw from the contract within 14 days of purchase. See our Refund Policy for the model withdrawal form and instructions.
9. Warranty and Liability
9.1 Legal Guarantee
Digital content must conform to the description provided and must be fit for the purposes for which such content is normally used. The legal guarantee period is 2 years from delivery for consumers in the EU.
9.2 Defective Content
If digital content is defective, corrupted, or does not match the description, you have the right to:
- Request a replacement at no additional cost
- Request a price reduction
- Request a full refund if repair is not possible
Claims must be made within 30 days of discovering the defect by contacting support@moretekk.com.
9.3 Limitation of Liability
To the maximum extent permitted by law, MoreTekk's liability is limited to the purchase price of the defective product. We are not liable for indirect damages, loss of data, or consequential losses.
10. Intellectual Property
All content on this website, including music, artwork, text, logos, and trademarks, is protected by copyright and intellectual property laws. All rights are reserved by MoreTekk or its licensors.
Unauthorized use, reproduction, or distribution of any content may result in civil and criminal penalties.
11. Account Termination
11.1 Termination by User
You may delete your account at any time through Account Settings. Purchased digital content licenses remain valid after account deletion, but you will lose access to download links after 30 days from purchase.
11.2 Termination by MoreTekk
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse our services. Notice will be provided where required by law.
12. Dispute Resolution and Applicable Law
12.1 Applicable Law
These Terms are governed by Spanish law. Any disputes will be subject to the jurisdiction of Spanish courts.
12.2 Consumer Dispute Resolution
If you are a consumer in the EU, you have the right to use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
12.3 Complaints
For any complaints, please contact support@moretekk.com. We will respond within 7 business days and aim to resolve all issues within 30 days.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on our website at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the updated Terms.
